The Federation of State Massage Therapy Boards (“FSMTB,” or “we,” “us,” or “our”) is a 501(c)(3) not-for-profit organization based in Overland Park, Kansas. This Privacy Notice (“Notice”) provides information about FSMTB’s collection and use of personal information collected through the FSMTB website located at www.fsmtb.org (“Website”) and by other means.

 

For the purposes of this Notice, references to FSMTB include the Massage & Bodywork Licensing Examination (MBLEx®), FSMTB Education Verification Center (EVC), FSMTB Examination Account, the Massage Therapy Licensing Database (MTLD™), CE Registry™, Regulatory Education and Competence Hub (REACH™, www.reach4ce.org), and all other FSMTB programs and services without limitation.

 

FSMTB may change this Notice at any time and will post a notice of such changes with the revised Notice on the Website. We recommend that you review this Notice regularly, as your continued use of the Website or participation in FSMTB programs and services after any such update will constitute your acknowledgement of the updated Notice and your agreement to abide by and be bound by that Notice.

 

  1. INFORMATION WE COLLECT

 

  • Personal information you provide to us. You may provide personal information to us, including your name, contact information, date of birth, social security number, and demographic information such as your age, gender, race, and ethnicity, when you correspond with us, participate in our programs, or use our services (i.e. when applying to take an exam or registering for a course). We may also collect personal information you provide when you post on our Website or in public forums. FSMTB does not knowingly collect personally identifiable information from children under the age of thirteen.

 

We may supplement the information you provide to us with data we receive from third parties, such as schools, employers, Member Boards, our exam administrator, state licensing databases, continuing education warehouses, the Interstate Compact Commission, or address verification services.

 

  • Usage data automatically collected. FSMTB and our service providers may automatically collect information regarding your usage of the Website, including pages visited and links clicked, information about your browser and operating system, and your Internet Protocol (IP) address. We may also use publicly available resources to approximate your geographic region and Internet Service Provider based on your IP address. See also the Cookies section below.

USE AND DISCLOSURE OF INFORMATION.  FSMTB collects and uses your personal information to operate and deliver the services you have requested, to improve our services, and to inform you of other products or services available from FSMTB and its affiliates. FSMTB does not sell, rent, or lease your personal information to third parties. However, due to the nature of our services, your personal information may be available in public-facing databases, including licensing databases. FSMTB endeavors to keep certain personal information confidential, including applications for licenses and results of examinations.

 

Below, FSMTB sets forth in more detail how we use your personal information.

 

  • To Provide Services. We may use the personal information you provide to us to create your online account; to verify your identity; to send you information about products, programs, services, and offers and targeted content; to complete your online order; to provide customer support; for internal record keeping; and for general administration to provide services. We may also share your personal information with third party service providers, including IT service providers and payment processors, who provide services on our behalf.
  • To Improve our Services. We may collect certain data automatically when you use our Website to better understand how you use the Website and improve our services.
  • For Research or Statistical Purposes. FSMTB may collect, process, and share aggregated data, including demographic data and survey results, with our members, affiliates, agents, and partners for various administrative and research/statistical purposes.
  • As Required to Participate in Government Programs. FSMTB may share aggregated data as may be required to participate in government programs and initiatives.
  • As Part of a Business Transaction. If we merge with or are acquired by another entity, your personal information may be transferred. In such instances, FSMTB will notify you via email or place a prominent notice on the Website of any such change in control, as well as possible resulting changes to this Notice.
  • As Required or Permitted by Law. We may disclose your personal information to law enforcement or a government agency in response to a search warrant, subpoena, or other legally valid inquiry or order, or to an investigative body when required or permitted by law. We may also disclose your personal information where necessary for the establishment, exercise, or defense of legal claims; to protect our interests or preserve our rights; to protect the safety, rights, or property of FSMTB’s constituents; or as otherwise permitted or required by law.

 

  1. COOKIES AND COMPUTER-RELATED INFORMATION. We may utilize first party and third party cookies, web beacons, tags, login files, and other similar data collection or tracking techniques, including Google Analytics to enhance and tailor your experience while using the Website to your preferences and to help us analyze web traffic to improve our services. We do not share information collected through these technologies for cross-contextual advertising. Most web browsers automatically accept cookies and similar tools, but you can alter the configuration of your browser to refuse, block or disable cookies. However, in some cases if you refuse cookies, you may not be able to take full advantage of all of our online features or access certain sections of our Website.

 

  1. LINKS TO OTHER SITES. Our Website may contain links to third-party sites that we do not own or operate. These links are provided as a convenience but are not intended to be an endorsement of or referral to the linked websites. This Notice does not apply to those sites, and we recommend that you carefully read the privacy statements, notices, and Terms of Use of the third-party sites you visit. YOUR CHOICES AND RIGHTS.  You can review, correct, and delete certain personal information within the Profile section of your online FSMTB account or by contacting us as detailed at the end of this Notice. You may opt-out of receiving commercial emails from us by clicking on the “unsubscribe” link in promotional email we send. You may be afforded additional privacy rights under applicable privacy laws, including rights to access your data or receive a copy of your data. To discuss or to exercise these rights, where applicable, you may contact us through any of the methods listed at the end of this Notice.

 

  1. FSMTB uses commercially reasonable security measures to help protect your personal information from unauthorized access or disclosure. Please be aware, however, that no measure can fully guarantee the security of data that is transmitted over the Internet or stored electronically.

 

  1. GOVERNING LAW. This Notice is a legal document and should be interpreted under the laws of the State of Kansas, without regard to conflict of law principles.

 

  1. CROSS-BORDER DATA TRANSFERS. FSMTB, the Website, and all programs are services are based in the United States. If you decide to use the Website or services, your personal information will be transferred to the U.S. and processed according to the terms described in this Notice. The laws in the U.S. may not be considered adequate by authorities in your home country. If you prefer not to have your personal information transferred to the U.S., do not use our Website or services. Otherwise, by using this Website and our services, you expressly consent and authorize FSMTB to transfer your personal information to destinations outside your home country, mainly the U.S., and process the personal information according to the terms of this Notice. If any part of this Notice is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision or part will be deemed suspended by a valid, enforceable provision that most closely matches the intent of the original provision or part and the remainder of this Notice will continue in full force and effect.
